Are your required to get SR22 car insurance automatically if you are convicted of driving under the influence?

Since the laws in all States di, the answer would NO. It is not always a requirement to get SR22 when you get convicted of DUI. In most states an SR22 car insurance is required to have your license reinstated and not as part of your penalties for DUI conviction. So if you get convicted of DUI and your license is suspended, you may be required to obtain an SR22 car insurance as part of your reinstatement process.

The following states does not require SR22 car insurance:

  • Delaware
  • Kentucky
  • Minnesota
  • New Mexico
  • Oklahoma
  • Pennsylvania
  • New York (does not require SR22 filings)
  • North Carolina (does not require SR22 filings)

Instead of SR22 car insurance, there is also an FR44 that is similar with SR22 that is required after DUI convictions. This FR44 has higher liability limits compared to SR22 and used in Florida and Virginia.

Check with the Department of Motor Vehicle in your state to know if DUI conviction will require an SR22 car insurance.

Q: What is SR22 insurance for non owners?

A: Non owner car insurance is something you only see when it comes to SR22 insurance, for the most part, although it does exist for other reasons. Some people who are required to have SR22 policies do not actually own cars, but do occasionally drive cars which belong to other people. Since driving with a suspended license is dangerous and illegal (unless you’re Paris Hilton), most people don’t want to take the risk, and so get their license reinstated even if they won’t be driving often, and to do that they need an SR22insurance policy.

SR22 insurance for non owners only covers you when you’re driving a car that isn’t yours. If you end up buying your own car, then you will need to switch over to regular SR22 car insurance.

A few more limits come with  SR22 insurance for non owners. One is that you are only able to purchase liability coverage. If you drive a car which already has comprehensive and collision coverage with its owners policy, this shouldn’t be a problem. Discount options for people with SR22 are also more limited.
