Reader’s Question:

Are your required to get SR22 car insurance automatically if you are convicted of driving under the influence?

Paul

Manhattan, NY

Since the laws in all States di, the answer would NO. It is not always a requirement to get SR22 when you get convicted of DUI. In most states an SR22 car insurance is required to have your license reinstated and not as part of your penalties for DUI conviction. So if you get convicted of DUI and your license is suspended, you may be required to obtain an SR22 car insurance as part of your reinstatement process.

The following states does not require SR22 car insurance:

  • Delaware
  • Kentucky
  • Minnesota
  • New Mexico
  • Oklahoma
  • Pennsylvania
  • New York (does not require SR22 filings)
  • North Carolina (does not require SR22 filings)

Instead of SR22 car insurance, there is also an FR44 that is similar with SR22 that is required after DUI convictions. This FR44 has higher liability limits compared to SR22 and used in Florida and Virginia.

Check with the Department of Motor Vehicle in your state to know if DUI conviction will require an SR22 car insurance.

Reader’s Question:

I live here in New York and usually rent a car whenever my own car is in repair. Do I need to have a separate insurance for rental cars?

Anna

Manhattan, NY

Rental car insurance is always a confusing matter for most of us. Renters buy supplemental rental car insurance for $20 to $40 per day for fear of what might happen if they refuse. What many of us do not know is that additional rental car insurance is mostly unnecessary if you have sufficient car insurance coverage. Before renting a car in New York, it is good to call your car insurance agent. Inquire about how much coverage you have on your car.

Generally, whatever deductibles and coverage you have on your car insurance would apply to your rental car. If you have removed the collision or comprehensive coverage on your car insurance policy, your rental car will not be covered if it was damaged or stolen.

Ask your agent if your insurance provider covers towing fees or administrative charges. Some car insurance companies cover these for their policyholders and may prove to be less expensive since you would not need to buy full coverage through the rental car company.

The next thing to do before renting a car is to call your credit card company. Companies like Visa, American Express and Discover may shoulder comprehensive damages to most vehicles. MasterCard offers secondary coverage to its platinum and gold card holders.

Reader’s Question:

I am planning to move to Manhattan, New York from CO and I am wondering if I also need to change my drivers license to NY and if its possible to keep my car insurance in CO.

Brad

Manhattan, NY

According to the New York State Department of Motor vehicle you must apply for a New York driver license not more than thirty days after you become a New York resident. You also have thirty days after you become a resident to register your car in the state of New York. When you apply for a NY title and registration you must have valid New York liability car insurance. According to the NYS DMV you cannot show proof of insurance from a different state under any circumstances.

Most insurance providers would not want to keep insuring you if you and your automobile are now garaged out of state. The garaging location of the automobile is essential to an insurance provider and once you move into a new state normally they will suggest you to obtain insurance now from that state in Manhattan, New York, especially since state financial responsibility or insurance laws vary from state to state.
