Reader’s Question:

I have an unregistered car in community parking lot. Because of the insurance lapse in NY, my registration is suspended so I returned the car plates. But my community apartment parking management warned me of towing my car because it is not registered. Since I do not have a private home, where should I store my car? Is there a temporary parking registration? Where can I get this?

Mishi

Brooklyn, NY

As you are aware, registration and driver’s license will be suspended indefinitely if the car is without insurance and he owner fails to surrender the vehicle plates to the New York DMV.

On the otherhand, a lapse in your insurance coverage in New York State and failure to immediately surrender the vehicle plates will suspend the registration for the same number of days that the car is without an insurance but has held the vehicle plates. You should pay the termination fee of $25 when the suspension period ends to reinstate your driver’s license.

The site of New York State Department of Motor Vehicles provides a list of the civil penalties amounts for registration suspensions caused by insurance lapse. You can look for a private storage facility to solve you parking situation until you get your plates back and reinstate your registration since most of the pubic lot, like your apartment’s parking lot, will tow vehicles if the parking lot management finds out that the car is without a registration.

You can check with NYS DMV if there is any temporary parking registration or any other type of decal that you could place on your car while it is in current location so that the car will not be towed.

Reader’s Question:

Do you know what the penalties would be for car insurance lapse in Oyster Bay, New York.

Bill

Oyster Bay, NY

Anytime that your automobile is registered but not insured in the state of New York it can cause a car insurance lapse in your insurance coverage and registration suspension. The NYS Department of Motor Vehicles should inform you once they are aware of a car insurance lapse in your vehicle insurance by a through a certified letter in the mail. This letter will show you instructions on how you need to show proof that you have car insurance or sold the automobile. If you cannot provide proof , you will need to surrender your car license plates to the New York State DMV so make sure you get the receipt.

You may not be required to return your license plates for a insurance lapse of ninety days or shorter if you pay a civil penalty fine. I suggest that you contact the DMV to know exactly how much is the fine. If the insurance lapse in Oyster Bay, New York exceeds ninety days your driver license will be suspended. If you do not surrender your license plates to the Department of motor Vehicle they will suspend your driver license and registration indefinitely. Your need to pay a fee of $25 to reinstate your drivers license.

Reader’s Question:

What is the time limit to file a claim to car insurance after a collision in New York?

Lincoln

Babylon, NY

You should contact your specific insurance company’s claims department to determine additional details on the time limits there are to make car collision claims. As for the NY state laws, you can contact your state insurance regulator to get more information on any time limits you have to make a car insurance claim and also on what the laws are regarding time limits for the insurance carrier to respond to the claim.

In New York, if your vehicle is damaged or stolen and you have car comprehensive or collision insurance coverage, you have the right to a fair and prompt settlement from your insurance carrier, either for the actual cash value of the vehicle or the amount of the damages, whichever is lower. If your vehicle is stolen and subsequently recovered, your insurance company must pay for the damage done to the vehicle while it was missing, the cost of any reasonable storage charges, towing and substitute transportation expenses.

Reader’s Question:

I have a driver’s license in Florida and am I moving to Amherst New York State. I am purchasing a vehicle in NYS, do I need a New York driver’s license to register and insure the car in New York?

Kelly

Amherst, NY

If you have proof of your residency in NY you should be able to obtain NY insurance on your car so that you can register the car you are purchasing in New York . Your insurance company will need to give information concerning your New York driver’s license though when you turn in your driver’s license in FL for a New York State license.

If possible it would likely be best to get your registration and insurance set up if you already have your New York license. It is New York State law that resident of New York must apply for a NY driver’s license within thirty days of becoming a resident anyway so if you do this before you buy the car it could make things easier.

To be able to register a car in New York you must have NYS insurance on it. Out of state insurance coverage is not valid or accepted to register a vehicle in New York.

No One Will Sell Me SR22 Auto Insurance?

Q: What do I do if I can’t find anyone who will sell me SR22 auto insurance? I live in New York.

A: First of all, widen your search for SR22 insurance a little bit more. Instead of looking at only the bigger companies, try searching for companies which are specialized and only insure people who are high risk. These companies are more rare and also cost more, but you can be pretty sure you will be able to get a policy from one of them when you find one.

However, even this doesn’t always work, and if you exhaust your resources looking, then you might have to get your  insurance coverage elsewhere.

The last resort for anyone looking for SR22 insurance is to join in the New York state high risk assigned insurance pool. If you can’t find insurance anywhere else, you can join the pool and be guaranteed to be insured. You will be assigned a company and that company will have to insure you. The catch is that you have to take whatever company you get, and it will be VERY expensive.
