Since the laws in all States di, the answer would NO. It is not always a requirement to get SR22 when you get convicted of DUI. In most states an SR22 car insurance is required to have your license reinstated and not as part of your penalties for DUI conviction. So if you get convicted of DUI and your license is suspended, you may be required to obtain an SR22 car insurance as part of your reinstatement process.

The following states does not require SR22 car insurance:

  • Delaware
  • Kentucky
  • Minnesota
  • New Mexico
  • Oklahoma
  • Pennsylvania
  • New York (does not require SR22 filings)
  • North Carolina (does not require SR22 filings)

Instead of SR22 car insurance, there is also an FR44 that is similar with SR22 that is required after DUI convictions. This FR44 has higher liability limits compared to SR22 and used in Florida and Virginia.

Check with the Department of Motor Vehicle in your state to know if DUI conviction will require an SR22 car insurance.

According to the New York Insurance Law, Property damage Liability insurance is defined as insurance against legal liability of the insured, and against loss, damage or expense incident to a claim of such liability, arising out of the loss or destruction of, or damage to, the property of any other person, but not including any kind of insurance specified in paragraph thirteen, fifteen or twenty-eight of this subsection.

So if your vehicle is damaged in a car accident and it is the other drivers fault then, you may be able to place a car insurance claim against that other party’s car insurance policy for Property Damage Liability. According to the New York State Insurance Department you may also go to court against the other driver for property damage.

On my way to my mother’s house I parked next to the curb, got out of my car, but noticed it was a little too far so I parked it closer. What ended up happening was the rear end of my car hit the front bumper of the car behind me. The driver came out and called the cops. I got two tickets for DWI and reckless driving. If you have collision and comprehensive coverage in New York, then you can make a claim with your insurance company. Normally, if you were in an accident where your vehicle has sustained physical damage, the claim would go under your collision coverage and the deductible associated with this coverage would be due.

Since you’re the one at fault for the accident, you can file a first party claim with your own insurance company. If you have sustained damage to your own vehicle, you would need to place a claim under your collision coverage claim. Then you will need to pay the deductible that you choose at the inception of your policy when you use your own physical damage coverage to repair your vehicle.

Be ready to explain the situation that occurred and have witness statement available to the insurance company to make the claims process easier. There is something you can do, though. Rather than tossing all  insurance to the wind, you simply get less of it. For security reasons, many people pile their vehicles up with insurance, such as comprehensive and collision and high liability limits, but for many people it isn’t necessary.

Cut off all types of insurance other than liability, such as comprehensive and collision. As for the rest of what you have, lower the coverages on your SR22 insurance policy to the lowest amount allowed.
