I have had a lapse in car insuranceĀ  coverage inĀ  NY. Can I turn in my tags and transfer my vehicle title to my brother and have him insure it so I can use my vehicle to get and forth to work?

According to the New York State Department of Motor Vehicle they will not issue a new registration if they determines that the reason for the new registration is to avoid the license suspension.

The New York State DMV will not issue a registration if the applicant for the new registration:

  • has the same last name as the registrant whose registration is suspended , or
  • resides at the same address as the registrant whose registration is suspended

The Department of Motor Vehicle will not issue a registration to any individual unless that individual makes a sworn statement on form FS-2. The document certifies that the purpose of the application is not to avoid the results from the current revocation. The local DMV Office knows if the application will be rejected or accepted.

To check what your state laws permit in your current case, contact your DMV. You may also check what they advise for your case where you need to get to work and are unable to due to your current situation.

Will Auto Insurance Rates Increase in New York After Speeding Ticket?

I reside in Colonie New York and got 2 speeding tickets in Rhode Island. The second speeding ticket was just 5 days ago. Will my car insurance provider find out about the new ticket if I end up obtaining a different punishment? I would like to know if my auto insurance rates will increase because of this?

New York State’s Department of Motor Vehicles does not record out-of-state violations committed by New York motorists, except for when it is a major offense or the violation was happened in Quebec or Ontario. With same exceptions of Quebec and Ontario, the New York State DMV does not add points onto your driving record for out of state tickets.

Due to the rules of the NYS DMV, normally your RI speeding tickets would not show up on your Colonie NY driving record. If the violations are not listed on your driving record it is unlikely that your insurance provider would find out about them when looking at your MVR to increase your car insurance rates.

What is the penalty for a second offense if I drive with a revoked license in Clay, New York?

This violation of the law in New York is Aggravated Unlicensed Operation (AUO). If you get caught driving with a revoked license a second time within an eighteen month time period is an AUO-2nd degree and is a misdemeanor. The penalty is a minimum fine of $500, mandatory imprisonment up to 180 days or probation and a mandatory surcharge. If you do reside in Clay, New York you can obtain more information from the NYS publication “Suppose Your License Were Taken Away (C-12)” which is available at the DMV office

The NYS DMV states that if you are over 21 years old and convicted of an alcohol related driving violation, such as a DUI, in any other state (or in the provinces of Quebec and Ontario, Canada) your NY State driver’s license will be revoked for at least ninety days. If you are convicted in any of these jurisdictions of a drug related driving offense your New York State license will be revoked for at least six months.

If you are under 21 and convicted of any alcohol or drug related violations such as DUI that happened out of state your New York State driver license will be revoked for at least 1 year.

I got a ticket in White Plains, New York for driving 24 mph over the speed limit. I have a drivers license in Connecticut. I paid the fine and am now being charged a hundred dollars a year for the next three years for a “Driver Responsibility Assessment”. This is totally unfair assessment I do realize that I will not be able to drive in the state of New York for at least the next 3 years and I’m fine with that but will there be any effect on me here in Connecticut if I just ignore this?

According to the State of New York it has deemed necessary for a driver to pay the driver responsibility assessment if after November 18, 2004 if you are convicted of an alcohol-related traffic offense, you are convicted of a drug-related traffic infraction, a DMV hearing decides that you refused a chemical test or you received 6 or more points on your driver record during a period of eighteen months. The different infractions are assessed with different fees to pay for 3 years.

If you receive a statement from the New York DMV that informs you to pay a driver responsibility assessment, you need to pay the assessment. If you decide to ignore this, the DMV will suspend your driver license, your driving privileges or learner’s permit. Your driver’s license being suspended will probably affect your driving privileges in CT as well. Both states are part of a Driver License Agreement that permits DMVs to exchange information. Probably your CT driver’s license will be suspended for not paying the assessment in New York but for the specifics of what will happen I suggest that you contact your local DMV.
